  1. General provisions
    1. This Agreement is between the User and Incrinity SIA, a company registered in Latvia (reg. no. 40103828241), legal address Ūnijas iela 76a-30, Rīga, Latvija, LV-1084, operating the website malta.dating.mt (“Website”, “DATING.MT”).
    2. The user of the Website is considered a person who is registered in the Website online system and is registered in the Website database.
    3. By registering and using the Website, the User accepts these Terms & Conditions. If the User does not agree, he/she must not use the Website.
    4. We may update these Terms from time to time. Any material changes will be notified to Users by email or through a notice on the Website at least 14 days before they take effect.
  2. Services
    1. The main services of the Website are free. Users may also purchase a License for premium features, with pricing and details available on the purchase page.
    2. A License grants the User a limited, personal, non-exclusive, non-transferable right to use the Website and its premium features for the License period. No ownership rights in the Website or its content are transferred to the User.
    3. A License is valid worldwide and may only be used by the individual User who purchased it.
    4. DATING.MT may monitor usage to ensure compliance with these Terms. In case of misuse or breach, the User may be warned. In case of serious or repeated breaches, the License may be suspended or terminated.
    5. During the License period, the User is entitled to use all updates and improvements included in the purchased package.
    6. Users have a statutory 14-day right of withdrawal from purchase, unless they expressly consent to immediate activation of the License and acknowledge that withdrawal is then waived.
  3. Accessibility
    1. DATING.MT ensures accessibility of the Website to the extent that it is provided by the hosting company.
    2. The user commits to provide his/her Internet access to the Website independently. The Website will never grant Internet access for the user. In cases when the user does not have access to the Internet, it cannot in any way affect the Website governors and this Agreement.
    3. We aim to ensure the availability of the Website, subject to reasonable downtime for maintenance or circumstances beyond our control (force majeure, hosting issues). If a paid License is affected by extended unavailability due to reasons within our control, Users may request an extension of their License or a proportional refund.
  4. Termination
    1. We may suspend or terminate a User’s account if the User seriously or repeatedly breaches these Terms (for example, by promoting competing platforms, uploading illegal content, harassing other Users, or infringing third-party rights).
    2. If the Website terminates a License without fault of the User, the User will receive a proportional refund of the unused portion of the License.
  5. DATING.MT rights and duties
    1. The purpose of the Website is to provide automated dating services. We hope that the services we provide will lead to new, happy families.
    2. The Website may apply different pricing or discounts, which will be clearly disclosed before purchase. Users will never be charged without their prior consent.
    3. The Website processes personal data in compliance with the EU General Data Protection Regulation (GDPR). Details are set out in our Privacy Policy, which forms part of these Terms.
    4. To the maximum extent permitted by law, the Website is not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability for fraud, gross negligence, or where otherwise prohibited by law.
  6. User rights and duties
    1. Users must provide a valid email address for communication. All notices will be sent to the User’s registered email address and are deemed received when delivered to the User’s inbox, unless returned as undeliverable.
    2. Users agree to act with courtesy and respect towards others.
    3. Users remain responsible for any content they upload and must not infringe the rights of others.
    4. The Website may request access to GPS data to enhance matching features. Location data will only be collected with the User’s explicit consent, and may be disabled at any time. Providing location data is optional and not required to use the core Website services. The detailed use of GPS data is described in the Privacy Policy.
    5. The user may not place any textual inscriptions on the photo.
    6. The User may not, in communication with other Users, promote or invite others to switch to competing dating sites, portals, or applications. If this rule is breached, the Website may suspend or terminate the User’s account (and any associated License, if applicable). In such cases, the Website may also use automated systems to censor prohibited words.
    7. Uploading pornographic, illegal, or offensive material is prohibited.
    8. It is forbidden to use any automatic systems to get data from DATING.MT. In such cases, we may deny access to the DATING.MT system temporarily or permanently.
    9. Users must not solicit others to competing platforms.
  7. Dispute Resolution
    1. Any disputes shall be subject to the jurisdiction of the Latvian courts, without prejudice to mandatory consumer rights in the User’s country of residence.
